1. Scope of Services

Immigify provides technology-driven tools, resources, and structured petition support for employment-based U.S. immigration matters.

1.1 Our Role – We:

• Offer structured processes to help you prepare and organize petition materials in a clear, comprehensive, and standards-aligned format.
• Coordinate timelines, documentation, and communication relevant to your petition.

1.2 Compliance – All services are provided in accordance with applicable U.S. immigration regulations and other relevant laws.

1.3 Third-Party Involvement – We may engage third-party vendors (e.g., payment processors, translation services, cloud storage providers) to support your process. While we select vendors carefully, we are not responsible for their independent actions.

2. Fees and Payment

2.1 Non-Refundable Fees – All fees paid to Immigify are non-refundable under any circumstances, including withdrawal of the petition, denial by USCIS, or early termination of services.

2.2 Payment Terms – Payment must be made in full before services begin unless otherwise agreed in writing.

2.3 Additional Costs – Government filing fees, translations, courier charges, and other third-party expenses are not included in our service fees unless explicitly stated otherwise in writing.

3. No Guarantee of Outcome

3.1 Approval at USCIS Discretion – All petition determinations are made solely by the United States Citizenship and Immigration Services (USCIS) or other relevant government bodies. Immigify does not and cannot guarantee approval.

3.2 Best Efforts Commitment – We are committed to delivering high-quality, thorough preparation services designed to support your petition with well-organized, relevant evidence based on the information you provide.

4. Client Responsibilities

4.1 Accuracy of Information – You must provide accurate, truthful, and complete information and promptly update us if any details change.

4.2 Timely Documentation – You must provide all required documentation by the deadlines set by Immigify. Delays or incomplete submissions may affect outcomes or cause missed deadlines.

4.3 Active Participation – You must cooperate with our team, respond to communications promptly, and follow provided instructions for document preparation and submission.

5. Processing Times

5.1 Estimates Only – Any timelines we provide are estimates and not binding.

5.2 Government Discretion – USCIS or other government agencies solely determine processing times.

6. Confidentiality and Data Security

6.1 Confidentiality – We treat all client information as confidential and use it only for the purpose of providing services and as required by law.

6.2 Data Protection – We maintain administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, alteration, or destruction. See our Privacy Policy for details.

7. Intellectual Property

7.1 Ownership – All technology, content, and materials provided by Immigify, including the platform, tools, and workflows, remain our exclusive property.

7.2 Limited License – You are granted a non-exclusive, non-transferable license to use our platform and materials solely for your individual immigration process.

8. Limitation of Liability

8.1 No Liability for Certain Damages – Immigify, its officers, directors, employees, and agents shall not be liable for indirect, incidental, special, or consequential damages, even if we have been advised of the possibility of such damages.

8.2 Maximum Liability – To the fullest extent permitted by law, our total liability for any claim shall not exceed the amount you paid for the services in question.

9. Indemnification

You agree to indemnify and hold harmless Immigify from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from:

• Your use of our services.
• Your breach of these Terms.
• Your violation of applicable laws or third-party rights.

10. Governing Law and Dispute Resolution

10.1 Governing Law – These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

10.2 Dispute Resolution – Disputes that cannot be resolved through good-faith negotiation will be submitted to binding arbitration in Dallas County, Texas, under the rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

11. Amendments

We may update these Terms at any time. Updates will be posted on our website and are effective immediately upon posting. Continued use of our services constitutes acceptance of the revised Terms.
